Avvy Terms of Use

  1. When registering for our community, you must provide an e-mail address through which we can contact you if necessary. We may refuse a registration without stating reasons. Your user account is non-transferable and may be terminated at any time. Each user may create only one account.
  2. For the content you make available, you grant us the transferable, perpetual, irrevocable, and unlimited right in terms of time, territory, and subject matter to use, exploit, store, edit, expand, distribute, reproduce, publicly communicate, transfer to other media, reproduce in audio or visual form, or otherwise modify such content. We are not obliged to name the respective author.
  3. Posts in our community must not violate statutory provisions or third-party rights. It is also prohibited to post, distribute, or link to content containing defamation, discrimination, insults, hate, threats, or advertising. Furthermore, you must not share content that is pornographic, obscene, glorifies violence, or is otherwise offensive. Uploading copyright-protected material without the express permission of the rights holder is forbidden.
  4. If you believe that users are violating the above provisions, you can report such potentially unlawful content using the reporting tools we provide.
  5. Trusted flaggers within the meaning of the Digital Services Act likewise have access to these reporting tools. Reports from trusted flaggers are generally given priority, processed without delay, and brought to a decision.
  6. For reports under Clause 4 or Clause 5, the content of the report and the data submitted with it may be forwarded to the user who posted the reported content. The identity of the reporting person will only be disclosed to that user if absolutely necessary.
  7. Voluntary reviews of content and reviews of reported content are performed by our moderators. In individual cases, the review may include partial automated processing, but decisions are always made by a human.
  8. If these Terms of Use are violated, we are entitled to take the following measures:

– Warning the user
– Deleting content
– Blocking access
– Hiding content
– Delaying publication of content
– Restricting the use of our services, especially the ability to publish content
– Temporarily or permanently suspending the user account

 

  1. A user will be blocked only after prior hearing, unless this conflicts with the purpose of the blocking. When deciding on a blocking, we will consider the specific circumstances of the individual case and, in particular, the rights of those affected. Circumstances considered when determining whether a violation exists and how it should be sanctioned include at least:

– the absolute number of manifestly unlawful contents provided within a certain period,
– their relative share of the total number of individual items provided or reports made within a certain period,
– the severity of the misuse, including the type of unlawful content and its consequences, and
– the intentions pursued by the user, person, entity, or complainant, insofar as those intentions can be determined.

 

  1. If we take a measure or refuse to do so, we will inform the affected user or complainant of the measure and its justification within the scope of our legal obligations.
  2. Should any provision of this agreement be or become void, invalid, or unenforceable in whole or in part, or should a necessary provision be missing, the validity and enforceability of all other provisions of this agreement shall remain unaffected.
  3. This agreement is governed exclusively by the law of the Federal Republic of Germany if your habitual residence is in Germany or in a state that is not a member of the European Union. If your habitual residence is in an EU member state, German law also applies, but mandatory statutory provisions of the state in which you habitually reside remain unaffected.
  4. If you do not have a general place of jurisdiction in Germany or another EU member state, the exclusive place of jurisdiction for all disputes arising from this agreement is our registered office.
